RESTRICTED LICENSE. U.S. InfoSearch.com grants to Customers a restricted license to use the U.S. InfoSearch.com Services in accordance with the acceptable use(s) identified by Customer in the U.S. InfoSearch.com Application and Agreement.  The U.S. InfoSearch.com Application and Agreement has identified industry-specific appropriate uses for which its U.S. InfoSearch.com Services are to be used, and Customer agrees to state its appropriate use for any requested information prior to accessing it, to limit its use to those stated purposes, and to take appropriate measures so as to protect against the misuse of information provided pursuant to the U.S. InfoSearch.com Services.  Customer also agrees that it shall not access the U.S. InfoSearch.com Services from Internet Protocol addresses located outside of the United States and its territories without U.S. InfoSearch.com's prior written approval.  Customer shall not use the information provided hereunder for any purpose that would violate the privacy obligation policy and any other terms and provisions of the Gramm-Leach-Bliley Act (15 U.S.C. ' 6801 et seq.), the Federal Drivers Privacy Protection Act (18 U.S.C. ' 2721 et seq.), or any similar state or local statute, rule, or regulation.  Customer shall not use the U.S. InfoSearch.com Services for purposes governed by the federal Fair Credit Reporting Act (15 U.S.C. ' 1681 et seq.) including the purpose of serving as a factor in establishing a consumer's eligibility for (a)  credit or insurance to be used primarily for personal, family, or household purposes; (b)  employment purposes; or (c)  any other purpose authorized under the federal Fair Credit Reporting Act.  Customer shall abide by such legislation and rules and regulations as may be enacted or adopted after the date hereof.  Customer agrees that if U.S. InfoSearch.com determines or reasonably suspects that Customer is reselling or brokering the U.S. InfoSearch.com Services' programs or computer applications, or otherwise violating any of the laws or regulations described in these terms and conditions, U.S. InfoSearch.com may immediately terminate the delivery of, and the license to use, the U.S. InfoSearch.com Services.

 

PERFORMANCE. U.S. InfoSearch.com will use reasonable efforts to deliver the U.S. InfoSearch.com Services requested by Customer and to compile information gathered from selected public records and other sources used in the provision of the U.S. InfoSearch.com Services; provided, however, that the Customer accepts all information "AS IS."  Customer acknowledges and agrees that U.S. InfoSearch.com obtains its data from third-party sources, which may or may not be completely thorough and accurate, and that Customer shall not rely on U.S. InfoSearch.com for the accuracy or completeness of information supplied in using the U.S. InfoSearch.com Services. 

 

CHARGES.  For each response to a request for information, Customer agrees to pay to U.S. InfoSearch.com for use of the U.S. InfoSearch.com Services the applicable charge then prevailing for the information requested. Customer shall pay to U.S. InfoSearch.com fees in accordance with the prices as updated from time to time through online announcements, customer bulletins, and published price schedules. U.S. InfoSearch.com is not responsible for ensuring delivery of such updates, changes, additions, or deletions to any of its policies that may occur from time to time, and it is the Customer's responsibility to check the U.S. InfoSearch.com Service Website and/or publications for such notifications. All current and future U.S. InfoSearch.com pricing documents are deemed incorporated herein by reference.

 

INTELLECTUAL PROPERTY.  Customer agrees that Customer shall not reproduce, retransmit, republish, or otherwise transfer for any commercial purposes the U.S. InfoSearch.com Services' programs or computer applications.  Customer acknowledges that U.S. InfoSearch.com (and/or U.S. InfoSearch.com's third-party data providers) shall retain all right, title, and interest in and to the data and information provided by the U.S. InfoSearch.com Services under applicable contractual, copyright, and related laws, and Customer shall use such materials consistent with U.S. InfoSearch.com's interests and notify U.S. InfoSearch.com of any threatened or actual infringement of U.S. InfoSearch.com's rights.

 

PAYMENT OF FEES.  Customer shall be responsible for payment for all services obtained through Customer's access identification code, whether or not such code is used by Customer or a third party, whether with or without Customer's consent, provided access to Customer's access identification code is not the result of use by a person formerly or presently employed by U.S. InfoSearch.com or who obtains the code by or through a break-in or unauthorized access of U.S. InfoSearch.com's offices, premises, records or documents, or computer system.  Customer agrees that at all times during the term of this Application and Agreement it shall keep all passwords for use of U.S. InfoSearch.com Services confidential and shall provide such passwords only to individuals that have a need to know.  Customer shall pay U.S. InfoSearch.com for all charges incurred for the use of the U.S. InfoSearch.com Services on a prepaid or monthly basis, and Customer agrees to be electronically charged for these search fees.  At Customer's request, paper invoices can be mailed via the United States Postal Service at a cost of Ten Dollars ($10) per month, which will be included in Customer's monthly invoice as an additional itemized charge.  All payments are due within 20 days of the date of any invoice for the U.S. InfoSearch.com Services.  Customer understands that it will be notified via electronic mail regarding all unpaid balances due.  Customer shall pay interest at the rate of eighteen percent (18%) per annum from the date due on any charges not paid by the payment due date. All remittances shall be sent to U.S. InfoSearch.com, LLC 5330 East Main Street STE 101B Columbus, Ohio 43213. U.S. InfoSearch.com reserves the right to terminate this Application and Agreement and the right of Customer to use any information provided hereunder with prior notice to Customer upon any non-payment of fees by the date due.

 

TERM OF AGREEMENT.  This Application and Agreement is for services rendered and shall be in full force and effect during such periods of time during which U.S. InfoSearch.com is providing services for Customer.  Customer agrees that if it is found to be in violation of any specifications of this Application and Agreement, U.S. InfoSearch.com has the right to terminate Customer's access to the U.S. InfoSearch.com Services.

 

GOVERNING LAW.  The Terms and Conditions of Customer's use of the U.S. InfoSearch.com Services shall be governed by and construed in accordance with the laws of the State of Ohio, without effect to conflict of law principles.  Additionally, any action brought pursuant to Customer's use of the U.S. InfoSearch.com Services or pursuant to the terms and conditions of this Application and Agreement shall be brought within the jurisdiction of the courts of Franklin County, Ohio.

 

ASSIGNMENT. The license granted pursuant to this Application and Agreement to Customer to use the U.S. InfoSearch.com Services may not be assigned by Customer, in whole or in part, without the prior written consent of U.S. InfoSearch.com.

 

WARRANTIES/LIMITATION OF LIABILITY.  Neither U.S. InfoSearch.com nor any third-party data provider (for purposes of indemnification, warranties, and limitations on liability, U.S. InfoSearch.com and its data providers are hereby collectively referred to as 'U.S. InfoSearch.com') shall be liable to Customer (or to any person claiming through Customer to whom Customer may have provided U.S. InfoSearch.com service-related data) for any loss or injury arising out of or caused in whole or in part by U.S. InfoSearch.com's acts or omissions in procuring, compiling, collecting, interpreting, reporting, communicating, or delivering the U.S. InfoSearch.com Services.  If, notwithstanding the foregoing, liability can be imposed on U.S. InfoSearch.com, then Customer agrees that U.S. InfoSearch.com's aggregate liability for any and all losses or injuries arising out of any act or omission of U.S. InfoSearch.com in connection with anything to be done or furnished under this Application and Agreement, regardless of the cause of the loss or injury, and regardless of the nature of the legal or equitable right claimed to have been violated, shall never exceed $100.00; provided, however, that such limitation of liability shall not apply to U.S. InfoSearch.com's indemnification obligation detailed in Section 10 hereof; and Customer covenants and promises that it will not sue U.S. InfoSearch.com for an amount greater than such sum even if U.S. InfoSearch.com and/or third parties were advised of the possibility of such damages and that it will not seek punitive damages in any suit against U.S. InfoSearch.com.  U.S. InfoSearch.com does not make and hereby disclaims any warranty, express or implied, with respect to the U.S. InfoSearch.com Services provided hereunder; provided, however, that U.S. InfoSearch.com does hereby warrant that U.S. InfoSearch.com has complied with the law and applicable third-party data provider contracts in providing the U.S. InfoSearch.com Services.  U.S. InfoSearch.com does not guarantee or warrant the correctness, completeness, merchantability, or fitness for a particular purpose of the U.S. InfoSearch.com Services or the components thereof or information provided hereunder. In no event shall U.S. InfoSearch.com be liable for any indirect, incidental, or consequential damages, however arising, incurred by Customer from receipt or use of information delivered hereunder or the unavailability thereof.

 

INDEMNIFICATION.  Customer hereby agrees to protect, indemnify, defend, and hold harmless U.S. InfoSearch.com from and against any and all costs, claims, demands, damages, losses, and liabilities (including attorneys' fees and costs) arising from or in any way related to use of information received by Customer (or any third party receiving such information from or through Customer) furnished by or through U.S. InfoSearch.com.  U.S. InfoSearch.com hereby agrees to protect, indemnify, defend, and hold harmless Customer from and against any and all costs, claims, demands, damages, losses, and liabilities (including attorneys' fees and costs) arising from or in any way related to a breach by U.S. InfoSearch.com of the warranty made by U.S. InfoSearch.com regarding authorized provision of the data in Section 9 hereof.

 

SURVIVAL OF AGREEMENT.  Provisions hereof related to release of claims, indemnification, use of information and data, payment for U.S. InfoSearch.com Services, and disclaimer of warranties shall survive any termination of the license to use the U.S. InfoSearch.com Services.

 

AUDIT.  Customer understands and agrees that in order to ensure compliance with the GLB, the DPPA, and other similar laws, U.S. InfoSearch.com will conduct periodic reviews of Customer activity and may, on a random basis, contact Customer to provide documentation of executed searches. U.S. InfoSearch.com shall also investigate all legitimate reports of abuse or misuse of U.S. InfoSearch.com Services by Customer or others. Customer agrees to cooperate fully with any and all investigations. Violations discovered in any review by U.S. InfoSearch.com will be subject to immediate action including, but not limited to, termination of the license to use U.S. InfoSearch.com Services, legal action, and/or referral to federal or state regulatory agencies.

 

ATTORNEYS FEES.  The prevailing party in any action, claim or law suit brought pursuant to this Application and Agreement is entitled to payment of all attorney fees and costs expended by such prevailing party in association with such action, claim or lawsuit.

 

CUSTOMER CHANGE.  Customer shall notify U.S. InfoSearch.com immediately of any changes to the information on Customer's Application for U.S. InfoSearch.com Services, such changes in information to include changes in the Account Contact, Credit Card Application, Billing Contact, and Banking Information. U.S. InfoSearch.com reserves the right to terminate Customer's access to the U.S. InfoSearch.com Services or terminate license to use the U.S. InfoSearch.com Services without further notice upon receipt of any change in Customer's status which in U.S. InfoSearch.com's sole discretion would cause Customer to be unable to comply with its obligations under this Application and Agreement. 

 

RELATIONSHIP OF PARTIES.  Customer shall at no time represent that it is the authorized agent or representative of U.S. InfoSearch.com.

 

CHANGE IN AGREEMENT.  By receipt of the U.S. InfoSearch.com Services, Customer agrees to, and shall comply with, changes to the Restricted License and changes in pricing as U.S. InfoSearch.com shall make from time to time by notice to Customer via e-mail online click wrap amendments, facsimile, mail, or other written notification.  All e-mail notifications shall be sent to the individual named in the Account Contact Information section, unless stated otherwise in this Application.

  

The information submitted on this Application and Agreement will be used to determine eligibility for accessing information provided by Martin Information & Investigations, herein referred to as U.S. InfoSearch.com. We reserve the right to reject this Application and Agreement without reason or for any reason whatsoever, without recourse against U.S. InfoSearch.com or any of its employees, officers, directors, agents, affiliates, or other designees.  Additionally, the applicant hereby authorizes U.S. InfoSearch.com to independently verify the information provided herein.

 

To Submit Application: Print, fill out, and sign Application and Agreement and include copies of documentation verifying your business and professional license.  Examples of necessary documentation include: 1. Business License, 2. Professional License, 3. Corporate Charter or Similar Certificate of Organization for Partnership/LLC. Initial ALL pages of the Application, sign where indicated, and fax the Application and supporting documentation to U.S. InfoSearch.com at 614-386-2064.

 

AUTHORIZATION AND ACCEPTANCE OF TERMS: I HEREBY CERTIFY that I am authorized to execute this U.S. InfoSearch.com Application and Agreement on behalf of the Applicant listed above and that the statements I have provided in this Application and Agreement are true and correct.  Further, I hereby certify that the Applicant agrees to the terms and conditions set forth in this Application and Agreement.

By submitting your order, you also acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations. U.S. Info Search is not a consumer reporting agency & information contained in reports is derived solely from public & private records, which may not always be 100 percent accurate or complete. This information is not to be used for any purpose described under in the fair credit reporting act (FCRA). All searches are subject to legal restrictions, Terms and Use, and applicable law. By requesting any search, you certify that you are in, and assume full responsibility for, compliance with the legal restrictions and agree to indemnify, defend and hold U.S. INFO SEARCH harmless from any breach of any law by you, your agents or contractors and any damages, fees and costs associated therewith. Dispute Resolution: We value your input and suggestions and work hard to maintain 100% customer satisfaction. If you are not satisfied after giving us the opportunity to address your needs, we have agreed to use mediation and arbitration if necessary to resolve disputes through participation in the Better Business Bureau (Membership Identification, BBB Online). 

 

Anti-Stalking Laws: We support anti-stalking laws. Please be advised that it is against the law to use the information obtained from U.S. INFO SEARCH to stalk or harass others. Search requests on public officials, juveniles and/or celebrities are strictly prohibited.

 

Illegal and/or unlawful activity: U.S. INFO SEARCH will not knowingly provide information to persons who intend to use such information in contravention of the law. By ordering information & investigative searches, you certify that you intend to use the information for lawfully acceptable purposes and are responsible for any and all violations. Users who request information under false pretenses and/or submit false or misleading  information at signup may be subject to civil & criminal penalties, as well as administrative sanctions. By signing up or requesting services, you certify the search purpose is for that listed on your order and agree to be 100% liable for any partial or full material misrepresentations made by you or your representatives, including all cost incurred by U.S. INFO SEARCH.COM necessary to investigate, document, initiate or defend any and all actions of law.

If I'm not happy with my results. Can I get a refund': We will try to locate the individual you are seeking. However, we are limited by the amount and accuracy of the information that you provide us. Moreover, we are accessing records controlled by third parties and reporting the results to you. Since it costs us money every time we perform a search, you are paying for our service not the results. We value your business and would like to ensure your satisfaction. If you feel that we have made an error that we can correct please contact our Customer Service Department at 614-322-9992. Hours of operation are Mon-Fri: 8am - 5pm. Please include your order number in your correspondence if possible.

 

How do I fix incorrect  information found in a report': U.S. Info Search is not a consumer reporting agency and provides records found in Government archives and other public & private data sources. We access records controlled by third parties and report the results to you. In the event errors are found in this data, we will work with you to correct them through the supplier. Please contact our Customer Service at 614-322-9992  for further assistance if you believe this may be the case. Documentation of the order along with evidence that the record is not accurate will be necessary. 

 

Driver & vehicle records: All driver & vehicle records request are subject to Federal, State & Local laws and the driver privacy protection act (DPPA). Click here for permissible DPPA uses. By inputting your response and proceeding with your search, you  certify that you are in, and assume full responsibility for, compliance with the DPPA and you agree to indemnify, defend and hold U.S. INFO SEARCH harmless from any breach of the DPPA by you, your agents or contractors and any damages, fees and costs associated therewith. Information from this file may not be used to determine a customer's eligibility for credit, insurance or employment pursuant to the Fair Credit Reporting Act, (15 U.S.C. Sec. 1681).

 

Security Screening: U.S. INFO SEARCH screens all orders to reduce fraud & prevent unauthorized access. We reserve the right to decline any order that cannot be verified or that does not appear to be for an authorized or legally permissible purpose. Order forms submitted using cell-phones, PO Boxes, free email sites, and/or miss-matched credit card codes may automatically be rejected and are subject to extreme scrutiny prior to processing. By submitting your order, you agree to allow & expressly authorize U.S. INFO SEARCH to conduct due diligence as necessary to effect, administer or enforce a transaction authorized by you.

  • MAY NOT BE USED FOR LOCATING LOST LOVED ONES, FRIENDS, OR FAMILY FOR PERSONAL REASONS;
  • MAY NOT BE USED FOR PURPOSES THAT MAY CAUSE PHYSICAL OR EMOTIONAL HARM TO THE SUBJECT OF A REPORT;
  • MAY NOT BE USED FOR INDIVIDUALS INVOLVED IN AN ADOPTION;
  • MAY NOT BE USED TO LOCATE INFORMATION ON WELL KNOWN/HIGH PROFILE CELEBRITIES OR GOVERNMENT OFFICIALS;
  • MAY NOT BE USED FOR PURPOSES THAT ARE NOT WITHIN YOUR STATED NORMAL COURSE OF BUSINESS, OR TO RUN SEQUENTIAL SSN NUMBER SEARCHES.
PERMISSIBLE USES:
  • For use as necessary to effect, administer or enforce a transaction authorized by the consumer;
  • For use to prevent actual or potential fraud, unauthorized transactions, claims or other liability;
  • For use in required institutional risk control programs;
  • For use in resolving customer disputes or inquiries;
  • For use by persons, or their representatives, holding a legal or beneficial interest relating to the consumer;
  • For use by persons acting with the consumer's consent in a fiduciary or representative capacity;
  • For use in complying with federal, state or local laws, rules and other applicable legal requirements; and
  • For use and to the extent specifically permitted or required under other provisions of law and in accordance with the Right to Financial Privacy Act of 1978, to law enforcement agencies (including a Federal functional regulator, the Secretary of the Treasury, a State insurance authority, or the Federal Trade Commission), self-regulatory organizations, or for an investigation on a matter related to public safety.
AUDIT: Subscriber understands and agrees that in order to ensure compliance with applicable law and  U.S. INFO SEARCH.COM policies,  U.S. INFO SEARCH.COM may conduct periodic reviews of Subscriber activity and may, on a random basis, contact Subscriber to provide documentation of executed searches.  U.S. INFO SEARCH.COM shall also investigate all legitimate reports of abuse or misuse of  U.S. INFO SEARCH.COM Services by Subscribers. Subscriber agrees to cooperate fully with any and all investigations. Violations discovered in any review by  U.S. INFO SEARCH.COM will be subject to immediate action including, but not limited to, termination of the account, legal action, and/or referral to federal or state regulatory agencies.
